Dale’s Story

Dale was exposed to asbestos at a packing plant where he worked for 36 years. In the 1970s, the packaging company made steam panels for Oscar Meyer – steam panels insulated with asbestos. At the time, Dale and the other workers were not told of the health risks of asbestos exposure.

Years later, while enjoying a much-deserved retirement with his wife of 48 years, Dale’s lung filled with fluid. Doctors performed a biopsy and identified mesothelioma cells. Dale was officially diagnosed with mesothelioma.

“We were told to start the [lawsuit] process right away because there are so many bills,” said Dale’s wife Betty in a 2010 video interview. “Financially, you just needed to do that.”

“You have to make a decision, and you have to trust each other. And, that’s the only way things can work. And, we trusted Simmons and [our mesothelioma lawyer],” said Betty.

Many members of the Simmons Hanly Conroy team worked diligently on Dale’s case to pursue the best possible outcome for him and his wife. Dale’s mesothelioma claim process resulted in an asbestos settlement without trial which helped to cover Dale’s medical costs, including surgery to remove his left lung.

While Dale and Betty were able to secure the mesothelioma compensation they deserved for Dale’s asbestos exposure, they still had to battle the devastating disease. Sadly, Dale passed away from mesothelioma in August 2010.
