Two Environmental Victories Against Shell and Conoco

Hanly Conroy and co-counsel Simmons Browder Gianaris Angelides & Barnerd LLC had two recent victories in environmental litigation relating to contamination from an oil refinery in Roxana, IL. First, the United States District Court for the Southern District of Illinois upheld claims brought by the Village of Roxana for violations of a Village anti-dumping ordinance. Defendants Shell Oil Company, ConocoPhillips Company, and their affiliates – the former and current operators of the refinery – had asked the Court to dismiss the ordinance violations actions, or in the alternative, grant summary judgment to defendants, on a variety of grounds. The court denied the motions, and gave the green light for the Village’s actions to go ahead. In a related development, the same court certified as a class action the claims of more than a thousand homeowners in the Village of Roxana for damage to their property, and appointed Simmons Hanly Conroy and the Simmons firm as class counsel.
