Erin Gee is an attorney at Simmons Hanly Conroy in the Complex Litigation Department. She joined the firm in 2021 and focuses her practice on complex legal matters involving privacy, pharmaceutical and medical device issues.

Erin’s responsibilities include briefing, strategic research, and analysis of discovery and other factual matters, along with preparing documents to be filed with the courts.

“Many issues are won or lost before attorneys ever argue the case inside a courtroom,” Erin said. “One of the best ways we can serve our clients is to ensure their positions are accurately and persuasively presented to the court in filings.”

Analyzing Contrasting Perspectives

Erin has represented both defendants and plaintiffs in civil litigation and has served as a judicial clerk, giving her a unique perspective on the litigation process. When she considers a legal issue, she analyzes it from those contrasting perspectives to ensure she understands the strengths and weaknesses of a case so she can confidently advocate for clients’ interests.

“We have the responsibility and privilege to help clients through what is likely a very difficult situation,” she said. “As we provide them with counsel, it’s our goal to make that situation less burdensome.”

Protecting the Rights of Patients Injured by Hip Implants

Erin was a member of the trial team for the bellwether trials in MDL 2244, In re: DePuy Orthopaedics, Inc., Pinnacle Hip Implant Products Liability Litigation, in the United States District Court for the Northern District of Texas. Together, the three trials resulted in more than $1.5 billion in jury verdicts, and led to settlement of one of the largest MDLs in the country.

Erin helped with discovery, deposition preparation, expert reports, and other pre-trial responsibilities. She worked closely with Partners Jayne Conroy and Justin Presnal throughout that litigation, particularly with regard to pretrial, trial, and appellate briefing on a wide variety of legal issues.  She also helped with the firm’s individual cases pending in the MDL.

Erin further helped with individual cases pending in MDL 2391, In re: Biomet M2A Magnum Hip Implant Products Liability Litigation, in the United States District Court for the Northern District of Indiana. In addition to briefing various matters, Erin assisted Justin Presnal in handling one of the largest and most diverse post-global settlement/opt out group of Biomet plaintiffs, which resulted in settlements for all of those clients.

Background and Education

Prior to joining Simmons Hanly Conroy, Erin was an associate at a Texas firm, where she assisted partners in multidistrict litigation that involved more than 7,000 cases. She previously was a law clerk in the United States District Court for the Northern District of Texas.

Erin received a B.B.A. in Management from Texas A&M University and her J.D. from Baylor University School of Law. While there, she served on the Baylor Law Review and participated in both mock trial and moot court teams.
