FIRST JURY AWARD JUDICIALLY INCREASED

$7 Million

A New York Supreme Court jury awarded $4.6 million to Thomas McGlynn, who developed mesothelioma after working as a welder on ships in and around New York City in the 1970s and 80s. After a full trial, the judge granted a motion of additur, which increases the jury’s awards for both past and future pain and suffering, raising his verdict results to $7 million. This was the first time in NYCAL history that a jury’s award was judicially increased.

$40.1 Million

A New York Supreme Court jury awarded $40.1 million to Walter Twidwell, who was diagnosed with mesothelioma after being exposed to asbestos while serving in the U.S. Navy and working aboard vessels ported in New York and other areas. This is the largest pure compensatory verdict in NYCAL history.

Another recent verdict involved securing compensation for a New York pipefitter’s family. For more than a decade, Gerald Suttner was exposed to asbestos used in valves manufactured by the defendant, Crane Co. This asbestos exposure led to a pleural mesothelioma diagnosis, of which he died 12 months later at age 77.

After his death, Simmons Hanly Conroy attorneys Myles Epperson and Perry Browder, along with co-counsel, represented Suttner’s wife and daughter and recovered a $3 million verdict.

“The defendant’s use of asbestos and failure to warn workers and consumers of its dangers is inexcusable,” said Browder. “On behalf of Mr. Suttner’s family, we are proud to have won and held Crane responsible for its decision to use this lethal material in its products.”
