Across the country, thousands of individuals have been diagnosed with cancer after being exposed to glyphosate, the main ingredient in Roundup®, at their jobs or homes.
Those affected may be able to file Roundup legal claims against the manufacturer of this weed killer for failing to include the risk of cancer on the product’s warning label.
Partner Jo Anna Pollock leads the firm’s Roundup litigation efforts. She has decades of experience handling complex litigation cases and has helped secure billions of dollars on behalf of her clients.
Hear from Jo Anna about recent developments in the litigation, eligibility to file a claim, and how a Roundup attorney may be able to help your family take action.
What is the Roundup litigation against Bayer and Monsanto?
The Roundup litigation centers around claims that exposure to glyphosate in Roundup may cause cancer — and that Monsanto, which is now owned by Bayer, failed to warn people about this risk.
For years, Roundup has been widely used by agricultural workers, landscapers, and homeowners. However, some users have since been diagnosed with serious illnesses that have been linked to glyphosate exposure. This litigation is about helping those individuals and their families seek justice and financial compensation.
Many Roundup claims have been consolidated in what’s called a multidistrict litigation or MDL. This legal process allows similar claims to be grouped together in one court to make things more efficient.
What cancers are included in the Roundup MDL?
The main type of cancer we’re seeing in these cases is non-Hodgkin’s lymphoma, which affects the lymphatic system. There are also several subtypes of non-Hodgkin lymphoma that qualify, such as B-cell lymphoma, follicular lymphoma, and chronic lymphocytic leukemia.
Who can join the Roundup litigation?
Anyone who was diagnosed with non-Hodgkin’s or another Roundup-related cancer after regular exposure to the weed killer may be able to take legal action.
A lot of our clients spent years working in occupations that involved Roundup use, like farming and groundskeeping. We’ve also helped people who used Roundup at their homes to control weeds on their property.
If your family member passed away due to cancer caused by Roundup, you may also be able to join the Roundup litigation by filing a wrongful death claim on their behalf.
What does a Roundup cancer attorney do for clients?
Roundup cancer attorneys can gather evidence to prove that you were exposed to Roundup, collect documentation of your cancer diagnosis, and work with medical experts to draw a link between the two.
We’ll also meet with the attorneys representing Bayer and Monsanto to try and negotiate a settlement or represent you in court during a trial.
Throughout the whole process, your attorney will be there to answer any questions you may have and provide regular updates on the progress of your case.
How much do attorneys for the Roundup lawsuit charge?
At Simmons Hanly Conroy, you don’t have to pay our Roundup attorneys anything upfront when pursuing legal action, and we don’t charge any hourly fees.
Our firm works on what’s called a contingency basis, which means we only get paid if we recover compensation for you. This way, we can take on the financial risk of filing a lawsuit, so you don’t have to.
Has anyone received Roundup compensation?
Absolutely. Billions of dollars have already been paid out to families affected by Roundup cancers, both through settlements and jury verdicts.
Juries have awarded multimillion-dollar verdicts to quite a few victims, which really highlights the devastating impact that Roundup exposure has had on people’s lives and the extent of corporate negligence at play here.
What were past Roundup settlement amounts?
A number of Roundup victims have already received compensation. A few years ago, there was a major settlement worth upwards of $11 billion that resolved tens of thousands of claims filed against Bayer and Monsanto.
Since then, Bayer may have settled additional individual lawsuits outside of court, but the details of those agreements are often confidential.
What’s the latest Roundup litigation update?
Thousands of lawsuits are still currently pending in the Roundup MDL, and trials are taking place in state courts across the country.
Recently, a Georgia jury awarded $2 billion to a non-Hodgkin’s lymphoma patient, which was one of the largest verdicts to date in the Roundup litigation. While not every case will reach that kind of outcome, it’s promising to see such a large result for an individual.
Bayer has challenged some of these verdicts, but many are being upheld, and new trials continue to be scheduled.
Is there still time to join the Bayer & Monsanto Roundup MDL?
Yes. We’re still accepting new Roundup clients, but there’s only a limited amount of time for victims to take legal action.
Each state has what’s called a statute of limitations, which is basically a legal deadline to file a claim. It’s usually a few years from the time you were diagnosed or when you learned that your cancer may be linked to Roundup.
Once that deadline passes, you could lose your chance to pursue compensation, even if you have a strong case.
That’s why it’s important to contact a Roundup lawyer as soon as possible. We can learn more about your situation and explain what sort of legal options may be available to you.
