Although Oscar and Lupe were both born in Mexico, their paths crossed in Arizona when family members introduced them.
At the time, Oscar had a job as an underground construction worker. His days were spent installing water, sewer, and drain pipes throughout the city of Phoenix.
Despite the demands of his job, Oscar and Lupe soon started a family of their own. The couple’s children, Oscar Jr. and Isabel, grew up in a loving home where they learned the value of hard work.
“We were very happy because we had a very nice life,” said Lupe. “We had two children, so I also worked. And then, my husband started having health issues.”
Since the early 1900s, city planners used materials made with asbestos to build cities within the United States. As a result, many workers like Oscar spent years helping build our nation’s cities and unknowingly put their own lives in danger.
For 35 years, Oscar dedicated himself to his job — but nobody warned him about the dangers of asbestos. The majority of the water pipe he installed throughout his career was asbestos cement pipe.
After decades of exposure, Oscar’s first symptom was a persistent cough that wouldn’t go away. Eventually, he went to the doctor, who took a fluid sample from his lung.
The tests confirmed he had pleural mesothelioma, an aggressive cancer caused by exposure to asbestos.
Determined to make the most of the time he had left, he immediately began exploring his treatment options and reflecting on what mattered most — his loved ones.
Although they had been together for decades, Oscar and Lupe had never legally married. To them, a piece of paper wasn’t necessary to prove their love. But after his diagnosis, everything changed.
One evening, the family went out to dinner for Isabel’s 19th birthday, as was their tradition. After she blew out the candles, Lupe asked what she had wished for. Isabel replied, “For Dad to propose to you.”
When Lupe turned around, Oscar was down on one knee with a ring. One month later, they were officially married.
As the reality of his diagnosis set in, Oscar decided to take legal action in order to protect his family’s financial future. While watching TV, he saw a commercial for a mesothelioma law firm and called the number on the screen.
Soon after, someone from Simmons Hanly Conroy came to his home to meet with him directly, offering their knowledge and support.
“Well, my husband knew the disease was already far advanced, and that’s when he said he was going to look for legal help, so he could take care of the children and me,” said Lupe.
During this time, Oscar’s health declined, and Isabel and Lupe became his full-time caregivers. After class, Isabel would rush home to take her dad to chemotherapy while Lupe went to work. It was a difficult routine, but they did it out of love for him.
Tragically, Oscar passed away before his legal claim was resolved, just 13 months after his diagnosis. To honor his goal of seeking justice and compensation, Oscar’s family decided to continue with a mesothelioma claim after his death.
With Isabel still in school and unpaid medical bills piling up, the mesothelioma settlements they received provided much-needed financial support.
“It was good, and at the same time, it was very sad,” Lupe explained. “Because you are saying, ‘Is that what a life is worth?’”
While the family was grateful for the compensation after Oscar’s passing, they ultimately felt mixed emotions after suffering the loss of someone so meaningful to them under these terms.
“These companies could pay a billion dollars, and I’m still going to grab my shovel and go to work tomorrow. My mom is still going to work two jobs, and my sister is going to go to school,” said Oscar Jr. “The bottom line is, no money that could make up for the loss of my dad.”
Still, seeking mesothelioma compensation allowed the family to honor Oscar’s wishes. By continuing on the path he had started, they were able to ensure that his efforts to protect them were not in vain.
“He was the one that, you know, just saw the commercial on TV and was like, ‘Hey, why don’t I do this for my family?’” said Isabel. “So it was nice that we met that goal for my dad.”
At first, Isabel found herself acting as the translator for her family, as her parents spoke limited English. Thankfully, the team at Simmons Hanly Conroy had interpreters on staff, ensuring clear communication through the entire process.
